What you agree to, and what we owe you.

The app, and the App Store licence

To Be Fair is made by Comtev Ltd in the United Kingdom. You get it from Apple's App Store, and the licence for the app itself is Apple's standard one, the Licensed Application End User Licence Agreement, which you can read at apple.com/legal/internet-services/itunes/dev/stdeula. This page is the agreement between you and us for the service behind the app. Where the two disagree about the licence to use the app, Apple's is the one that governs it.

Who can use it

You need to be sixteen or older, and you sign in with Apple, which is the only way in. One account is one person. You are responsible for what is written from your account, so if somebody else has your phone and your Apple ID, that is worth knowing.

What you write

Every statement is about somebody who knows you and has agreed to keep a tin with you. Write things that are true and that you would say to their face on a good day. Do not use this to threaten, harass, humiliate or frighten anybody, and do not write about somebody who has not agreed to it.

What you write is yours. You give us permission to store it and to deliver it to the one person it was written for, and to nobody else. We do not use it to train anything, we do not sell it, and we do not show it to anybody else. The privacy notice says who can read what and under what circumstances, including the parts we would rather not have to say.

We can suspend or close an account that is being used to harm somebody. We would rather explain than act silently, so unless the law or somebody's safety stops us, we will tell you why.

The plan

The first ten sentences, the first six photographs and the first tin are free and stay free, and so is everything already written. Keeping the tin open past any of those is one plan, and it follows you rather than the pair. The fair hearing is never behind it.

The plan is 7.99 pounds a month or 31.99 pounds a year, and there is also a year that one person can buy for another. Payment is charged to your Apple Account at confirmation. A subscription renews at the same price unless it is turned off at least twenty four hours before the period ends, and you can see it, change it or cancel it in your Apple Account settings. We cannot cancel it for you and we cannot refund it: Apple takes the payment, so refunds are Apple's to give, and the way to ask is through Apple's own reporting page.

If a plan ends, nothing already in the tin is removed or hidden. New statements wait until it is open again. If we ever change a price, we will tell you before it applies to you.

What the app is not

It is a keepsake and a way of handing back things people already meant. It is not therapy, not medical or legal advice, and not a crisis service. If you feel unsafe, this is not the tool. Where to get help is one tap from Settings, and the numbers there are Refuge, Respect and Samaritans.

What we owe you, and what we do not

We will run the service with reasonable care and skill. We cannot promise it is never unavailable, and we do not promise a phone will never be lost or a message never delayed. The app is built to work with no signal for exactly that reason, and the statements on your phone stay readable when we are not reachable.

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Beyond that, and because this is a consumer service, we are not liable for losses that were not reasonably foreseeable when you started using it. Your legal rights as a consumer are not affected by anything on this page.

Ending it

You can stop at any time. Delete everything, on the Settings screen, closes your account and removes every statement and photograph of yours from our servers and from your phone immediately, and shows you a receipt listing each store that was cleared. The person you wrote to keeps what is on their phone, because it was written to them. Cancelling a subscription is separate and is done in your Apple Account settings.

Changes, and the law

If these terms change we will put the new date at the top of this page, and we will tell you in the app if the change is one that affects what you have already agreed to. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, though if you live elsewhere in the United Kingdom you can bring a claim in your own courts.
